On 1 July 2012, ASIC was given new powers, under s 489EA(1) of the Corporations Act 2001 (Cth), to order the winding up of a company in certain circumstances.
Michael Gronow, the author of McPherson’s Law of Company Liquidation, has written new commentary on these powers in the Chapter “Miscellaneous winding-up applications”. His commentary has been published in the September 2012 update of McPherson’s Law of Company Liquidation and covers the following:
