<p>We expect this work to be completed by the end of the week and normal updating to commence on Monday the 26th of March.   </p>
<p>The latest case updates will be available on Legal Online and we recommend you use this service if you have any concerns around currency.</p>

<p>We would like to advise that the change will impact on the subscriber login section of the home page.</p>
<p>The changes are minimal and the login feature remains in the same general location on the updated site.</p>
<p>You can click on the image to see the location of the logins in both the current and new sites.</p>
<p>The new login options will take you to the individual sites login page allowing you to take advantage of the full range of authentication options including OnePass. If you have saved your password previously you may need to re enter and save your password in the new login page.</p>
<p>If your organisation already links directly into our services via Deep Links or the individual service login pages you can ignore this change as it is not applicable and will not impact you in any way.</p>

The articles cover such diverse topics as personal injury resulting from negligence, recent changes to the arbitral legislative regime in Australia, and asset lending with an improvident borrower. The sections range from the annual report of the New South Wales Judicial Commission, to indefeasibility and forged mortgages and from admiralty jurisdiction to the obligations of creditor to guarantor, plus much more.</p>

The first article is by Chris Ohms and Karin Olesen and compares four Commonwealth jurisdictions in their handling of Interest payable on borrowed funds or on amounts owing. The second article comes from Sally Joseph and discusses the accessibility and application of the environmental protection provisions that provide a deduction for expenditure. The final article, by Hung Chu and Wayne Lonergan, discusses the valuation treatment of accommodation bonds and the confusion arising as a result.</p>

			<content:encoded><![CDATA[<p>The first update to<em><strong> Australian Sentencing</strong></em> highlights the rapidly changing and evolving nature of sentencing law and practice and the large degree of convergence of principles that apply to sentencing in all Australian jurisdictions.</p>
<p>Since the release of the Service, less than three months ago there have been several hundred sentencing judgments handed down by the High Court and appeal courts throughout Australia. More than 50 of these decisions are significant in that they either change existing sentencing law and practice or qualify it or elaborate on previously unclear areas. All of these 50-plus judgments are discussed in the first update.</p>
<p>Seminal cases include:</p>
<ul>
<li><em>Green v The Queen; Quinn v The Queen</em> [2011] HCA 49 where the High Court took a broad view of the parity doctrine;</li>
<li><em>Muldrock v The Queen </em>[2011] HCA 39 in which the High Court overturned the approach to setting parole period periods for offences which have standard non-parole terms. This approach had been established in the decision of <em>R v Way </em>[2004] NSWCCA 131 and hence stood unchallenged for seven years;</li>
<li><em>R v Marien </em>[2011] SASCFC 116 the Court discussed tariffs for child sex offences;</li>
<li><em>R v Matauaina </em>[2011] QCA 344 where the Queensland Court of Appeal undertook a detailed assessment of the tariff for thefts from an employer;</li>
<li><em>H A T v The Queen </em>[2011] VSCA, in which the Victorian Court of Appeal discusses the relevance of confiscation orders, and in particular automatic forfeiture, to sentencing. The Court in this case also examines the circumstances in which cultural background can be a mitigating consideration;</li>
<li>Castres v The Queen; Kent v The Queen [2011] VSCA 377, in which the aggravating nature of the prison context to assaults is examined at length.</li>
